A lawsuit launched by post-graduate student Ann Michelle Costa claims her doctors selected breast implants that were too large and were inserted incorrectly. It also claims they failed to warn her about potential problems associated with the implants.

Defendants include the doctor who performed the surgery – Nicholas Carr – and the businesses of J.L. Jang Inc. and Dr. F.L. Jang Inc.

Following the October 15, 2009, surgery, Costa started to feel chest pain and what she considers a “profound asymmetry of her breasts resulting primarily from the collapse of her left breast and a pooling of blood in the right breast.”

She alleges that her right breast was left with a laterally displaced left nipple as a result of the surgery and that Carr severed her pectoral muscles, causing the skin and muscle tissue to be detached from her sternum.

“The implants that Carr selected were too big for the plaintiff’s body size,” notes the statement of claim.

The B.C. government has had to make payments for health-care services as a result of the surgery.

Some payments had to cover drugs, devices and professional assistance.

Costa is seeking damages for pain and suffering as well as lost income and future earning capacity.
