Construction dust triggers lawsuit

Property owners next door to a renovation site have filed suit after concrete dust and debris allegedly adhered to and damaged the neighbouring property.

Property owners Paul Gacina and Theresa Gacina filed suit May 11 in BC Supreme Court against Jack Cewe Ltd., Jack Cewe, Carston Mide, Lightening Maintenance Construction Cleaners (LMC) and Kirsten Mide-Wilson.

The court document alleges that renovations on the Mide property caused dust and debris to travel next door onto the Gacina property.

“The concrete dust and debris adhered to the walls, glass railings, windows and doors and on the Gacina property,” it claims.

It further alleges that, when Mide and Mide-Wilson retained LMC to remove the dust and debris from the Gacina property, LMC’s actions caused additional damage.

“During the course of the removal, LMC used metal scapers and/or other instruments which caused further damage to the glass surfaces at the Gacina Property,” the statement of claim alleges.

The plaintiffs are seeking undisclosed damages.

None of these allegations has been proved in court.

As of press deadline, no response to the civil claim had been filed.
