Vancouver-based Hydromax Energy Ltd. has filed suit against various Spanish and Slovenian companies, alleging that it has suffered damages due to defective turbine-generator equipment at its Lower Clowhom Hydro Project north of Sechelt.
The suit contends that Hydromax contracted Litostroj Hydro Inc. in 2007 for the design, fabrication and installation of turbine-generator equipment for the project.
It then alleges that in 2010, bolts and washers installed in the equipment came loose during operation, resulting in “extensive physical damage” to the equipment.
“The … defendants, and each of them, negligently breached their duty of care owed to Hydromax by failing to manufacture and supply the equipment that was reasonably durable, fit for the purposes of the project, and free of defects,” the court document contends.
Hydromax is seeking damages for loss of profit and property damage, plus general and special damages.
Defendants named in the suit include Ingeteam Corporacion S.A., Ingeteam Power Technology S.A., Indar Electric S.L., Indar Maquinas Hidraulicas S.L., all of Spain. Also named are Slovenia-based Litostroj E.I. d.o.o. and Litostroj Steel Ltd.
None of these allegations has been proved.
As of press time, no response to the civil claim had been filed.
