More than $2 million in allegedly unpaid bills for electrical work is behind two lawsuits filed against Hotel Georgia Development Ltd. by electrical contractor Nightingale Electrical Ltd.
The statements of claim, both filed in BC Supreme Court on September 23, are collectively seeking $2,111,555 in damages and builders liens totalling $2,111,555 for work allegedly done for Hotel Georgia Development.
Both statements of claim allege that a certificate of completion was issued to Hotel Georgia Development on July 18, regarding the work outlined in the respective subcontracts.
“In breach of its contract with [Nightingale], the defendant has refused or neglected to make payment, despite demand,” reads a suit seeking $1,356,021 and a lien for the same amount.
The second suit, seeking $755,534, makes the same allegation.
On September 20, Hotel Georgia Development filed a petition with the court against Nightingale for the cancellation of a $1,356,021 lien in return for depositing the equivalent amount of cash with the court registrar. The petition contended that the lien claim filed by Nightingale was “filed out of time” and that the lien claim and any related certificates of pending litigation should be cancelled for seven land titles.
At press time, no statements of defence had been filed.
None of these allegations has been proven in court. •
