Reclining seat lands WestJet in hot water

A Vancouver airline passenger has filed suit against WestJet Airlines Ltd., two unnamed corporations and a fellow unidentified passenger in connection with a seat-reclining mishap.

A Vancouver airline passenger has filed suit against WestJet Airlines Ltd., two unnamed corporations and a fellow unidentified passenger in connection with a seat-reclining mishap.

According to a BC Supreme Court notice of claim filed September 2, Deborah Butkowski was on a WestJet flight to Ottawa on September 2, 2009 when a passenger in front of her reclined, spilling a cup of hot water onto Butkowski.

The incident resulted in significant scalding and blistering to Butkwoski’s abdomen and lap, it is alleged.

Courts documents also allege WestJet, as well as two unnamed companies related to the beverage water heating machines used to heat the plaintiff’s cup of water, are responsible for the mishap.

The suit also alleges the passenger directly in front of Butkowski is responsible for the incident.

Butkowski is seeking damages against all defendants under the Health Care Costs Recovery Act.

A notice of response had yet to be filed at press time. •
