A man is suing Simon Fraser University (SFU) for injuries he allegedly sustained at SFU’s downtown campus when he mistook a tarp for solid ground and fell through a hidden hole.
Plaintiff Kieran Neuenfeldt is contending that SFU and other defendants are liable under the Occupiers Liability Act for injuries he sustained as the result of a tarp or sheet that was stretched over an atrium opening at floor level in February 2010. According to the suit, the sheet was stretched across the opening on the second or third floor of the premises.
“The sheet was level and contiguous with the floor of the premises at that location and gave the impression of a solid floor in the area of the atrium,” reads the suit, which was filed November 9 in BC Supreme Court.
The suit contends that on February 18, 2010, Neuenfeldt “jumped over a railing and fell through the sheet that had been placed by the defendants over the atrium and down to the floor below, sustaining injuries.”
Also named as defendants are: Lord Realty Holdings Limited, Privest Properties Ltd., Kevin M. W. Willis, John J. Henry, James W. Milton, Kimberley D. Seale doing business as Concord Security, Concord Security Corporation and Concord Security Systems Corp.
Neuenfeldt is seeking damages including the cost of health-care services.
None of these allegations has been proven in court.
